Dear FHA Members,
Legislation was introduced by Senator Jason Brodeur on Friday aimed at protecting patients and providers from harmful prescription drug policies often pursued by insurers and pharmacy benefits managers (PBMs). FHA-supported language has been included in the bill, which prohibits insurer-mandated white bagging policies that detract from safe and effective administration of drugs from clinician to patient. FHA crafted similar legislation in 2022 and has continually worked with legislators to educate them about our hospital’s challenges with unfair white bagging policies.

Additionally, FHA is analyzing the rest of the bill language posing stronger regulations against spread pricing and financial claw-backs, which prevent drug savings from passing to the consumer. FHA looks forward to working with Governor DeSantis, Senator Brodeur, and leaders in the Florida House to pass language that advances the mission of Florida’s hospitals to continue providing high-quality health care to their communities.
